Plain English

What is the Divorce and Consent Order Service?

It is an all-in-one online service for people who want the divorce application handled and their financial agreement made legally binding.

The divorce application deals with legally ending the marriage. The consent order deals with the financial agreement, such as property, pensions, savings, debts, maintenance or a clean break.

The key point: getting divorced does not automatically settle your finances. This service is designed to handle both parts together where the financial agreement has already been reached.
1

The divorce application

The application is prepared and submitted online for suitable England and Wales cases.

2

The financial agreement

You provide details of what has been agreed about money, property, pensions, debts or maintenance.

3

The consent order

A solicitor drafts the financial consent order so the agreement can be sent to court for approval.

4

The court approval

A judge reviews the draft order and financial information before deciding whether to approve it.

This service may be right for you if...

Your divorce will be dealt with in England or Wales.
You have been married for at least one year.
You want the divorce application prepared and submitted for you.
You and your ex have already agreed the financial settlement.
You want that agreement made legally binding through a consent order.
You want one joined-up service instead of handling divorce and finances separately.

Another option may be better if...

!You have not agreed how finances will be divided.
!One person is hiding assets or refusing to provide financial information.
!There is pressure, abuse, coercion or you feel unable to negotiate safely.
!The agreement may be unfair, rushed or not fully understood.
!There are complex business assets, overseas assets, trusts or disputed pensions.
!You need advice on what you should agree, not just help recording what has already been agreed.

Timescale

How long does divorce plus a consent order take?

The divorce has fixed waiting periods. The consent order timing depends on how quickly both people provide financial information, how complex the agreement is and how long the court takes to review the order.

The court cannot approve a consent order before conditional order, so the financial order needs to be planned around the divorce timetable.

Typical guide Divorce first, order approval after conditional order The divorce usually takes at least 26 weeks. The consent order can be prepared while the divorce is moving forward.
1

Divorce application issued

The court issues the divorce application and the 20-week waiting period starts.

2

Consent order prepared

The financial agreement, Form D81 information and draft order can be prepared while the divorce process continues.

3

Conditional order

After the 20-week period, the conditional order stage allows the financial consent order to be considered by the court.

4

Final order

The final order legally ends the marriage. It is usually sensible to make sure financial order timing is properly considered before final order.

Questions

Divorce and consent order FAQs.

Is this service for England and Wales only?

Yes. This page is about divorce and financial consent orders in England and Wales. Scotland and Northern Ireland have different legal procedures.

Do finances need to be agreed first?

Yes. A consent order records an agreement. If you have not agreed finances, you may need mediation, negotiation or solicitor advice before this service is suitable.

Can the consent order be approved before conditional order?

No. The court cannot approve a consent order before conditional order. The order can be prepared earlier, but approval comes at the correct stage of the divorce.

Does this include the court fees?

No. Court fees are separate. Current court fees include £612 for the divorce application and £60 for an application by consent for a financial order.

What if we have no assets?

Is Divorces.co.uk a law firm?

No. Divorces.co.uk is an information website and is not a law firm. The planned service will need appropriate solicitor support for the consent order drafting and legal parts.
